Terms and Conditions (Awnings)

 

These terms and conditions shall apply to all contracts between Creative Blinds and Shutters and the customer (s) and no variation of these terms and conditions shall be effective unless agreed in writing and signed by a duly authorised representative of the company.

Definitions in these terms and conditions and in all contracts to which these terms and conditions apply:-

The customer shall mean yourself

The company shall mean Creative Blinds and Shutters

The goods shall mean awning range and fabric agreed on which shall constitute the contract

The quotation/order document  shall constitute the contract

Quotations

All quotations by the company represent an invitation to the customer to place an order and do not constitute a legal offer. All prices are quoted without commitment and are subject to alteration or withdrawal by the company without prior notice.

Terms of payment

The customer shall pay a non refundable deposit of 50% and a further 40% on delivery of the goods to us the remaining 10% shall be paid to the fitters on completion.

Cheques shall be made payable to CBS Ltd.

The customer shall not be entitled to withhold payment by reason of any minor defect. The company will use its best endeavours to investigate and rectify any alleged defects.

Completion

The company will ensure they shall complete the installation of the awning within a reasonable time and that it will do all that it can to meet the date given for installation. However the company cannot be held responsible for delays due to circumstances beyond its control. If the company cannot install on time, this is not deemed to be a breach of contract. In such circumstances the company will not make any payment for any loss, whether direct or consequential that the customer might suffer.

Alterations

Alterations to orders cannot be accepted once the survey has been completed any variations post survey to orders may result in additional costs for which the customer may be liable.

Since the goods are made to each customers individual requirements, the order cannot be cancelled once manufacture has commenced. Manufacture usually commences within 24 hours of the order being placed with the company. This clause does not affect the customer’s statutory rights to cancel (cooling off period) pursuant to the Consumer Credit Act where applicable.

Liability

Our patio awning fabrics are high performance materials designed to provide both a functional and decorative role, however, despite meeting the highest European standards and laboratory tests, they can only be manufactured to a limited degree of perfection even with today’s state of the art machinery. The below imperfections sometimes give cause to complaint, but these natural characteristics which occur with all installed awning fabrics cannot be eradicated, however, they do not alter the performance or useability of patio awnings in any way.

Fabric characteristics

The fabric characteristics document attached forms part of these terms and conditions.

Crease Marks: These originate from the making up of awning fabrics, with crease marks appearing as a dark line/streak when the fabric is under bright light. This effect is especially noticeable on lighter coloured materials.

Waviness / Rippling: This occurs along the side hems, around the seams and in the centre of the fabric panels. This happens due to the arrangements of the made up awning fabric, with double layers / thicknesses of material where the fabric is joined and where it is folded at the side.

Puckering / Dimples: Our patio awning fabrics are impregnated with a water repelling finish so they can withstand, subject to having an angle of 14 degrees (or greater) short periods of light rainfall. Puckering / dimples form in the centre of the fabric panels and around the seams when the fabric is subjected to persistent rain showers or heavy downpours.

Streching: The fabric is permanently kept under tension via 2 or more powerful spring loaded folding arms. The hems to the side of the material act as a re-inforcement strip but are also subject to the greatest levels of pressure resulting in the side hems elongating, therefore causing the sides of the outside panels of fabric to sag.

Warranty

CBS Ltd offers a 5 year guarantee on all the following complete products including hardware, fabric (excluding valance), motorisation and control systems: Tortola, Bahamas, Grenada, XL Grenada, Haitian. All other products including the Anguilla awning, Jamaican window canopy, spare parts and accessories come with a 1 year parts only guarantee. Valances and gear boxes including gear eyes and winding handles are not covered under the guarantee. The guarantee does not cover fair wear and tear (including gearboxes, gear eyes and winding handles), misuse of the goods, incorrect installation / adjustment, accidental damage or adverse environmental conditions.

In such circumstances the company will not make any payment for any loss, whether direct or consequential that the customer might suffer.

Liability

In the unlikely event that the original colour has been discontinued the nearest alternative will be offered.

All colours are subject to a variance of +or- 10%

Internal shutters when fitted can cause a thermal barrier which could result in condensation on customers windows

At the customer’s request the company can provide a colour matching service for shutters and the company will endeavour to match the chosen sample as close as possible but no guarantee is given that the match will be exact

Tolerance levels of overall panel specifications are plus or minus 3mm and the product will not be considered defective if falling within the size range. Warp on any component part vertical or horizontal shall not exceed 1mm per 300mm and shall not be considered defective if within this tolerance

The contract assumes that the customer’s windows will be out of square and as such there will be visible gaps between the window recess and the shutter or the fabric of the blind

Warranty

We guarantee shutters that we have supplied and installed against defects in manufacturing and or installation for a period of Five years on all solid wood ranges and Three years on all other ranges, blinds guarantee will cover 12 months, The warranty timer period for all goods and Services commences from the day the goods are fitted.

Goods that have been subject to unreasonable abuse, whether accidental or otherwise will not be covered under the given guarantee
